GOODBYE......YELLOW BRICK ROAD

Some of the more eagle-eyed among you might have noticed that last Saturday's posting, which was the third in the occasional series that highlighted some Skeletons In My Closet, is no longer anywhere to be found. Here's why......

Blogger has been notified, according to the terms of the Digital Millennium Copyright Act (DMCA), that certain content in your blog infringes upon the copyrights of others. The URL(s) of the allegedly infringing post(s) may be found at the end of this message.

The notice that we received from the International Federation of the Phonographic Industry (IFPI) and the record companies it represents, with any personally identifying information removed, will be posted online by a service called Chilling Effects at wttp://www.chillingeffects.org. We do this in accordance with the Digital Millennium Copyright Act (DMCA).

Please note that it may take Chilling Effects up to several weeks to post the notice online at the link provided. The IFPI is a trade association that represents over 1,400 major and independent record companies in the US and internationally who create, manufacture and distribute sound recordings (the "IFPI Represented Companies").

The DMCA is a United States copyright law that provides guidelines for online service provider liability in case of copyright infringement. We are in the process of removing from our servers the links that allegedly infringe upon the copyrights of others. If we did not do so, we would be subject to a claim of copyright infringement, regardless of its merits.

See http://www.educause.edu/Browse/645?PARENT_ID=254 for more information about the DMCA, and see http://www.google.com/dmca.html for the process that Blogger requires in order to make a DMCA complaint.Blogger can reinstate these posts upon receipt of a counter notification pursuant to sections 512(g)(2) and 3) of the DMCA. For more information about the requirements of a counter notification and a link to a sample counter notification, see http://www.google.com/dmca.html#counter.

Please note that repeated violations to our Terms of Service may result in further remedial action taken against your Blogger account. If you have legal questions about this notification, you should retain your own legal counsel. If you have any other questions about this notification, please let us know.

Sincerely,The Blogger Team

So if you're a fan of Elton John, dont expect to find too many bloggers talking about him......

Unhappy reading.

shame - a lot of it about... but the hounders seem somehow able to miss the very many full-album & new release blogs; even those on easy targets like blogger - I don't get it. Presumably they're using dumb-ass software to search for keywords rather than taking a big pic look at it.

Mind you, I 'spect the torrent side makes blog postings look teensy; hmm, and then there's all the Russian 'legal' sites that some ppl use cuz "it's not stealing' even though near-zero reaches the artist - hey ho.

Cool blog - thanks.

The internet police seem to doing their ram-raid campaign again - I've noticed several blogs getting another wallop. I'm sure to get a second whack at some point..

I've had two takedowns in the past week. One Aretha Franklin tune and one random old soul tune, that was on one of my Sunday postings. That was a weird one, cos it was on a post with about 7 other tracks and they all still remain with my file host but the one random one is gone. And I can't for the life of me work out why that particular tune went. Never mind.

Fuck him - he's a gobshite anyway. He's probably waiting for Jade goody to die to rehash 'Candle in the Wind' again.

(How odd - my word verification was 'shite')

It's all getting more difficult.

I'm running out of words for this issue - I feel like all I can do is repeat my arguments until I'm blue in the face. Artists as big as Elton John and Prince frankly don't deserve a place in the music blogosphere - their attack on blogs via this IFPI organization or bodies like it merely proves they're irrelevant dinosaurs. I'm sorry to hear about this.

Sorry to hear about this JC. the bad feeling that can be caused by artist's and this evil act is unbelievable. Don;t let the bastards grind you down.

I'd like to know if there's a way to DMCA-proof our blogs. Some people have been known to post mp3s in the comments sections. Maybe it's time to get more militant...

They got me too. Deleted The The's Uncertain Smile 12-inch (from April 2007) and suspended my Fileden account.

I had a Sam Phillips song taken down, too, and received the same email. If you check Chilling Effects, don't expect to find anything related to your takedown anytime soon.

Wankers.

The fucking The. What has Matt Johnson come to ? Was he not the enemy of global capitalism when I was young and impressionable. If you're out there, you should be ashamed.

Elton also. For all his pish records, at least the man seems to genuinely enjoy music of varying genres. Shame that he isn't prepared to encourage people to hear stuff that otherwise they would have no access to. How many indie kids give the Queen E a chance? You never know - a million OJ fans converted.

I missed the post in question so what could it be ? Knowing you, I'm assuming some taste so I won't suggest Nikita. Saturday Night's Alright..., Bitch is Back and Bennie and the Jets must be in with a shout. Everyone loves Tiny Dancer. Ghetto Gospel with 2pac won't count. Hmmm. Surely not the Brick Road. I'm off to play some Rod Stewart and study my Elton collection....... "Oh yeah. In these days of changing ways, so called liberated days, a story comes to mind, a friend of mine......."

Thanks everyone...especially you Sir Elton for sharing your thoughts with us. It all makes perfect sense now....

Like JtK, I'm astonished by the fact that The The have been caught up in this - Mick, if you still have a copy of that notice, why not drop Mr Johnston a note and see if he's anything to say....

And I'm thinking that Santa might bring Uncertain Smile to folk on 25December......

Good Grief! What a curmudgeon.

I did manage to get it while it was up, but don't feel particulaly inclined to listen to it now, in case I should inadvertantly encourage anyone else to give EJ a go. He would hate that, obviously.

I knew that no good would come of posting Elton John.

Of course I have no way of knowing but my gut instinct is that Matt Johnson is not directly involved with my takedown. What they dont realise is I still have the b-sides here and the Fileden links work even though my account is suspended.
